Date: July 7, 2010
To: File No. C-1981-008
From: David Berry
Re: Transcript of voice mail recording received by David Berry at 303-866-3567 extension 8106
Message received: July 7, 2010 at 9:52 a.m. from JoEllen Turner
Hi Mr. Berry, this is JoEllen Turner. I'm just trying to get an answer from you if you're going to be able
to come this week or would it do any good for me to call that Director that Loretta Pineda and ask her if
she could send somebody or send you or something else. I just as soon work with you because we've
gone through all this for months now and you probably know exactly what I'm talking about which I'll
have to start completely over with somebody else. And this Permit Revision Number 6 that they
brought to us they want to start from 2008 forget everything has ever happened, and we cannot write a
PR6 by not getting all these facts straightened out, because that's the day they got caught, that's the day
that we caught them and found out the rules and the laws and said whoops, you know, you guys are
lying to us. But that is not the day it took place, you know, and, and we've found so much more
documentation now where they already knew it was prime farmland, not just from Jim Irvine saying,
but from the US Department of Agriculture and everything, they already knew it was prime farmland.
Just like I told you, when Lance and them stood over there they said, there'd never be another drop of
prime farmland on this place. And they just covered it up and, and draw the paperwork of changing
things, rewriting things, everything else. You know the state just didn't know what they were doing or
anything else because they never come out here and see this. Can you please call me back and let me
know where I go from here. Thank you.
