III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division). Rob Zuber of DRMS was also present for the <br /> inspection. All that remains within the small permit area are 1.2 acres at the NW-1 <br /> ventilation shaft, seeded and mulched in late 2004. Upon arrival, the gate to the gas road <br /> was found closed and locked as usual. Access to the reclaimed area was pedestrian. The <br /> weather was hot with partly cloudy skies. Ground conditions were dry and no evidence of <br /> significant rainfall in the recent past was noted. <br /> Hydrologic Balance <br /> According to the operator's representative, well site 218A will be abandoned using the same <br /> drilling contractor who is currently conducting exploration drilling for the New Elk Coal <br /> Company in the vicinity of this mine permit area. The last Division cost estimate from August <br /> 2008 (SL-06) includes bond monies for reclamation of five other wells including SF-2, NM-20, <br /> NM-21, NM-22, and NM-23. Direct costs held for reclamation of these drill holes is <br /> approximately $21,000.00. <br /> Revegetation <br /> The reclaimed ventilation facility pad area appears unchanged from previous inspections. <br /> Many grasses have set seeds and overall vegetative cover appears good. No sign of grazing <br /> by domestic livestock was noted. Weeds were not noted and have not been a problem on <br /> this small reclaimed area in the past. Nothing unusual or out of the ordinary was observed. <br /> 3 <br />
