Division approval; <br />(d) Wildcat Mining will submit the Conversion Application by September 30, <br />2010; <br />(e) Wildcat Musing will provide the Division with all required materials in adequate <br />form-to -allow a final. decision on the Conversion. Application within 180 days of the,. <br />Conversion Application filing date; <br />(f) Once the application is filed, Wildcat Mining will provide application <br />materials to the Division at least two weeks prior to applicable process deadlines the <br />Division sets; <br />(g) Wildcat Mining and the Division agree to extend the decision date for the <br />pending application for a permit amendment to the May Day Mine permit, to <br />September 30, 2010. <br />(h) Once Wildcat Mining submits the Conversion Application by September 30, <br />2010, Wildcat Mining shall withdraw its pending application for the amendment to its <br />May Day Mine permit. <br />(4) If and when Wildcat Mining obtains approval from the Division (if no <br />objections are filed) or from the Board (if objections are filed) of the conversion <br />application, the following violations shall be deemed resolved, which will then allow for <br />issuance of the 112 permit upon Wildcat Mining's submittal of the proper Performance <br />and Financial Warranty: <br />(a) Violation for mining without a permit ('Violation MV-2009-007) for <br />constructing an access road at the Idaho Mill site, issued March 11, 2009; <br />(b) Violation of the Cease and Desist Ender of Violation MV-2009-007 for use of <br />the unpermitted road at the Idaho Mill site (MV-2009-033) issued December 10, <br />2009; <br />(c) Violation for constructing an unpermitted portal at the Level 1 area at the May <br />Day Mine site (MV-2009-35) issued December 10, 2009;
