DECEIVED <br />JUL 15 2010 <br />Division of RscWms# n. <br />IYtlniN and *a#* <br />BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />JUL 0 9 2010 <br />Durango Field Office <br />Division of Reclamation, <br />Mining and Safety <br />IN THE MATTER OF WIP&T MINING CORPORATION, MAY DAY NNF, <br />PERMIT No. M-1981-185; Idaho Mill, File No. M-2006-069; and IDAHO MINE, File No. <br />M-2010-003 <br />JOINT STIPULATION TO ADDRESS ALL PENDING REGULATORY ACTIONS <br />The Division of Reclamation, Mining and Safety ("Division"). and Wildcat Mining <br />Corporation ("Wildcat Mining") have discussed resolution of all pending matters <br />concerning the Idaho Mill, Idaho Mine and the May Day Mine. Based on the parties' <br />discussion, the parties hereby continue all pending regulatory actions with the following <br />conditions and understanding: <br />(1) The parties hereby continue the following regulatory actions that are currently <br />set for the Board's July 12, 2010 meeting to August 11, 2010 for a status update: <br />(a) Wildcat Mining continues its administrative appeal filed pursuant to Rule <br />1.4.11, regarding the Division's denial of Wildcat Mining's 110 application <br />for the Idaho Mine; <br />(b) Wildcat Mining continues its petition for declaratory order concerning the <br />Idaho Mine application; and, <br />(c) The Division continues its request for a bond forfeiture hearing regarding <br />the Idaho Mill interim bond.' <br />(d) The parties request that all regulatory actions described above be set for a <br />'Please note that prior to 2010 Wildcat Mining filed documents in which the site was called the Idaho Mill. On January <br />21, 2010, Wildcat Mining filed anew permit application and referred to the site as the Idaho Mine. Accordingly, <br />specific reference is made to the Idaho Mill and the Idaho Mine site, as well as the May Day Mine.
