Wildcat Mining responds that it is in compliance with all Board orders, and that it will comply with <br />all local, state and federal laws. The May Day Mine permit amendment application is a Section <br />110(2) application proposing disturbance of less than 10 acres. Wildcat Mining has properly <br />addressed water rights and management, access and reclamation, including mill reclamation, in its <br />amendment application. <br />8. Antoinette Nowakowski, dated April 20, 2010. <br />Ms. Nowakowski objects on grounds that Wildcat Mining is violating local and state law. <br />Wildcat Mining responds that it is in compliance with all Board orders, and that it will comply with <br />all local, state and federal laws. <br />9. Ken and Veniece Fagerlin, dated April 22, 2010. <br />Mr. and Mrs. Fagerlin object on grounds that Wildcat Mining's access road should not be deemed <br />legal without improvements, that Wildcat Mining proposes mining activities on more than 10 acres, <br />that Wildcat Mining might temporarily cease operations for 10 years, that Wildcat Mining might <br />process ore from other mines, that Wildcat Mining's mill facility is in violation of rules, and that <br />Wildcat Mining is in violation of laws. <br />Wildcat Mining responds that it has submitted to DRMS a Road Construction Work Plan to address <br />road stability concerns. Wildcat Mining proposes to disturb less than 10 acres in its May Day Mine <br />permit amendment application. Wildcat Mining has no plans to temporarily cease operations. <br />Wildcat Mining does not propose in its May Day Mine permit amendment application to process ore <br />from other mines. Wildcat Mining's May Day Mine permit amendment application propose to <br />incorporate its mill into an approved permit. Finally, Wildcat Mining is in compliance with all <br />Board orders, and that will comply with all local, state and federal laws. <br />10. Steve and Peggy Palazzola, dated April 19, 2010. <br />Mr. and Mrs. Palazzola object on grounds that Wildcat Mining has allegedly not complied with law <br />relating to certain activities or facilities. <br />Wildcat Mining responds that it will address all compliance matters set forth in DRMS and Board <br />orders, and that it will operate and reclaim the May Day Mine in accordance with applicable laws <br />and regulations as outlined in the submitted permit application. <br />11. Christopher Hughes, dated May 31, 2010. <br />Mr. Hughes objects on grounds that Wildcat Mining is inexperienced and has allegedly not complied <br />with law. <br />Wildcat Mining responds that it does have sufficient experience to operate the Idaho Mine, and that <br />to bolster its experience it has retained experienced engineering and legal consultants. Wildcat <br />Mining further responds that it will address all compliance matters set forth in DRMS and Board <br />orders, and that it will operate and reclaim the May Day Mine in accordance with applicable laws <br />and regulations as outlined in the submitted permit application.
