First, the potential affected land identified by Mr. Collignon is addressed by Wildcat Mining in its <br />permit applications for the May Day Mine and the Idaho Mine. The former location of the mill on <br />the Idaho site is part of the Idaho Mine permit application. The Chief Portal is described in the Mine <br />Plan for the existing May Day Mine permit, and is part of the amendment application. <br />Second, Wildcat Mining has submitted a Road Construction Work Plan as part of its adequacy <br />responses for the Idaho Mine permit application, and fully intends to perform stabilization work <br />necessary for the access road. <br />Third, Wildcat Mining believes a recreation use is appropriate for the May Day Mine area post- <br />mining, and is committed to the reclamation measures set forth in its amendment application. <br />2. Lisa Giovanniello, dated April 16, 2010. <br />Ms. Giovanniello objects on grounds that Wildcat Mining has placed certain equipment and <br />materials on the Idaho Mine property which have not been reclaimed, that Wildcat Mining has <br />violated rules, that the May Day Mine should be properly bonded, that the bridge and access road <br />must be addressed for safety reasons, and that the road work will increase affected area and require a <br />Section 112 permit. <br />First, any equipment or materials located at the adjacent Idaho Mine will be addressed through the <br />permit application for the Idaho Mine. Wildcat Mining will perform appropriate reclamation upon <br />completion of mining activities and as called for in its approved permit and reclamation plan. <br />Second, Wildcat Mining has resolved certain alleged compliance issues stemming from activities in <br />2009 at recent Mined Land Reclamation Board (the "Board") hearings. Since resolving these <br />matters, Wildcat Mining has worked diligently with the Division of Reclamation, Mining and Safety <br />("DRMS") to address these matters, to achieve compliance with the Board's rules and to obtain <br />permits for the Idaho Mine and May Day Mine. <br />Third, Wildcat Mining agrees the May Day Mine should be properly bonded, and believes the bond <br />presently in place addresses all reclamation liabilities. <br />Fourth, Wildcat Mining has submitted a Road Construction Work Plan as part of its adequacy <br />responses for the Idaho Mine permit application, and fully intends to perform stabilization work <br />necessary for the access road and bridge. <br />Fifth, Wildcat Mining does not believe the stabilization work necessary on the access road or bridge <br />will transform the Idaho Mine permit application or the May Day Mine amendment application into <br />a Section 112 permit. <br />3. Dave Kingsley, M.D., dated April 19, 2010. <br />Mr. Kingsley objects on grounds that Wildcat Mining has allegedly failed to comply with local, state <br />and federal law. <br />Wildcat Mining responds that it is in compliance. with all Board orders, and that it will comply with <br />all local, state and federal laws.
