Pineda <br />Director <br />Janet Binns of the Division of Reclamation, Mining and Safety (Division) has reviewed the 2009 <br />Vegetation Monitoring report that is part of the SL-05 Phase II Bond Release Application. Per Ms. Binns <br />review, vegetation sampling of Area 23 did not meet sample adequacy per Rule 4.15.11(2). The Division <br />has identified three options to rectify this issue: <br />• Coors Energy Company (CEC) could respond with a letter discussing why CEC believes <br />sampling adequacy was in fact achieved. <br />• CEC could revise the bond release application to remove Area 23 from the application. <br />• CEC could resample Area 23, ensure that sampling adequacy is achieved, and (should the new <br />data still show that Area 23 meets the approved cover value) revise the application to submit the <br />new data. <br />CEC may also propose other solutions, which the Division will certainly consider.
