Clinton is
concerned about the proposed amendment to the Climax Mine permit and requests party status
and an opportunity to be heard at a hearing before the Mined Land Reclamation Board
(`Board"). The stated purposes of the proposed amendment are to adjust the affected land
boundary to encompass areas needed for planned future mine operations, as well as to update the
mining plan to accommodate the resumption of mineral extraction and production at the mine.
The resumed mining activities include significant expansion of the open pit mine, and
correspondingly large expansions of overburden storage facilities and tailings ponds.
Clinton owns property that is within the proposed new affected land boundary. The
Clinton Gulch Reservoir is immediately adjacent to the proposed new boundary. Clinton is
concerned that it may be adversely impacted by the proposed mining activities, including adverse
impacts to the prevailing hydrologic balance of the affected lands and of the surrounding area,
and to the quantity and quality of surface and ground water.
