Racine Director <br />Centennial, Colorado 80111 <br />Re: Vick Borrow Pit, File No. M-2010-048, Receipt of Special 111 Construction Materials Reclamation <br />Permit Application Package - Second Incompleteness <br />Dear Mr. Bell: <br />On July 8, 2010, the Division of Reclamation, Mining and Safety (Division) received your Special 111 Construction <br />Materials Reclamation Permit Application package incompleteness response for the Vick Borrow Pit, File No. M- <br />2010-048. The review of the information received determined the remaining items must be received before the <br />Division can consider your application as being submitted and technical review can begin: <br />1. Please provide completed copies, signed and dated, of Addendum 1- Notice as required by Rule 1.6.2(1) <br />(b). <br />Application Form <br />2. The Division requires the Operator name remain consistent and matches the exact name registered with <br />the Secretary of State's office (Castle Rock Construction of Colorado, LLC) throughout the application. <br />Please provide the Division with a revised and original (signatures in blue ink) copy of pages 1, 3 and 6 of <br />the application form. A copy of the summary page from the Colorado Secretary of-State-for Castle Rock <br />Construction of Colorado, LLC is attached for reference. --? <br />6.3.9 Exhibit I - Proof of Filing with County Clerk <br />3. Please provide an affidavit or receipt indicating the date on which the revised application was placed <br />with the local County Clerk and Recorder. <br />6.3.12 Exhibit L - Permanent Man-Made Structures <br />Where the mining operation will adversely affect the stability of any significant, valuable and permanent man- <br />made structure located within two hundred (200) feet of the affected land, the Applicant shall either: <br />(a) provide a notarized agreement between the Applicant and the Person(s) having an interest in <br />the structure, that the Applicant is to provide compensation for any damage to the structure; or <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
