According to subsection 2.05.6(6)(c)(i) on page 2.05-144, the subsidence monitoring <br />program for the Bruce Park dam and Bruce Park landslide will be suspended. Text <br />regarding the monitoring program has also been struck through on page •2.05-149. <br />However, page 2.05-158 appears to retain language regarding monitoring of the Bruce Park <br />landslide. Please review the various monitoring plans forthe Bruce Park Dam and Landslide <br />and verify that the permit text is internally consistent regarding the monitoring efforts <br />proposed. <br />Proposed deleted text was shown on revised pages 2.05-144 and 2.05-158 of the June <br />1, 2010 submittal. The proposed deletions resolve the issue. Under Rule 4.20.2, please provide documentation that owners of property, including <br />structures, and residents within the area above the underground workings and <br />adjacent areas have received the mining schedule as described in Rules 4.20.2(1), <br />(2) and (3). <br />Response not accepted. The Pitkin Mesa pipeline is "property" and will be subsided <br />with a worst case consequence of separation and/or disruption of the delivery of <br />water. The owner of this structure requires notification in exact accordance with <br />Rule 4.20.2. Please review Rule 4.20.2 and submit evidence that the owners of <br />property have been properly notified with at least the minimal information as <br />required by the Rule. <br />BRL - Under Rule 4.20.2 landowners must receive notification by mail at least six <br />months prior to mining beneath his or her property or residence.
