BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br />IN THE MATTER OF NUVEMCO LLC'S RECLAMATION PERMIT APPLICATION, <br />File No. M-2008-012 <br />THIS MATTER came before the Mined Land Reclamation Board (the "Board") on <br />June 9, 2010, in Denver, Colorado for a hearing to consider a section 112d(1) permit <br />application where resolution of adequacy issues extended beyond the allowed 365-day <br />review period. The file number is M-2008-012. Tom Cavanaugh appeared on behalf of <br />Nuvemco LLC (the "Operator"). Russ Means appeared on behalf of the Division of <br />Reclamation, Mining and Safety (the "Division"). <br />The Board, having considered the parties' presentations and having been otherwise <br />fully informed of the facts in the matter, hereby enters the following: <br />FINDINGS OF FACT <br />1. In 2008, the Operator filed a section 112d(1) reclamation permit application <br />for the Nuvemco Last Chance Mine, located in Section 12, Township 46 North, Range 18 <br />West, 10th Principal Meridian. The 49.98-acre site is located in Montrose County, Colorado. <br />The Operator plans to extract uranium. <br />2. In April 2009, the Operator submitted an amendment to the original <br />application to meet new requirements imposed by the legislature in House Bill 08-1161. <br />3. No objections or comments were received by the Division in response to the <br />official public notice. <br />4. After some back and forth communication between the Division and the <br />Operator, the application decision date ultimately was extended to April 15, 2010. <br />5. In March 2010, the Division had two remaining adequacy concerns that <br />required on-site data collection. The Division required additional data for the site's <br />Environmental Protection Plan. Because of unusually heavy snow in the area, the Operator <br />was not able to access the mine site to collect the required samples and data prior to the April <br />15, 2010 decision date. <br />6. The Operator was finally able to access the site at the end of April, 2010. The <br />Operator, with Division supervision, collected ore and waste rock samples and conducted a <br />radiometric survey of certain areas. <br />Nuvemco, LLC <br />Consideration of Permit Application <br />M-2008-012
