III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />A series of four boulder - supported terraces was constructed to transition from the higher, <br />reclaimed BB Detour elevations on Richards' parcel to the paved detour segment on <br />Benson -East that will be retained as a permanent feature. The terraces appear to have had <br />the desired effect of stabilizing the area to prevent erosion (Photo 7). <br />Two buried pipelines were previously installed for the purpose of carrying CCC Ditch irrigation <br />water across the Benson -East and Richards parcels to fields west of 2700 Road and south of <br />BB Road. Phase I bond release for these pipeline corridors was granted with SL -10 in February <br />2008. Revegetation of the corridor through the Benson -East parcel, which is irrigated, <br />appears to be somewhat successful, with alfalfa and rye becoming established (Photo 8). <br />Revegetation of the southern corridor on Richards (Photo 9) is coming along, but the east - <br />west line that follows the crest of the hill is dominated by annual weeds (Photo 10). <br />The first cutting of hay had occurred on fields east of San Miguel Draw. The hay had not yet <br />been baled, and was still in windrows, with the exception of a few bales on Goforth. Sideroll <br />sprinklers were operating on the Burbridge and WFC fields southeast of the 2700/BB Road <br />intersection. The sideroll sprinkler on the Benson -East was not in operation at the time of the <br />inspection. <br />Mr. Gubka stated that WFC is trying to hold off on mowing the Burbridge area until <br />vegetation sampling can be conducted. <br />The inspection concluded at 4:00 p.m. <br />New Horizon Mine C- 1981 -008 23- Jun -2010 <br />-3- <br />
