preparation for mining the B-seam and, according to Division records, was never submitted in PR-10 <br />for review by the Division. What was submitted in PR-10 and reviewed by the Division was the <br />September 2008 report. When PR-10 was approved, BRL provided a cd which contained copies of the <br />revised material. The June 2008 report was on that cd but the Division did not realize it. The list of <br />revised pages and maps for PR-10 included the September 2008 report but not the June 2008 report. <br />Since the June 2010 report was not formally included into the permit application and since the same <br />information is found on Map 10B, the Division requests that the reference to the June 2010 report be <br />deleted from revised page 2.04-34 and that the June 2008 report be replaced by the September 2008 <br />report in Exhibit 3 of Volume III of the Bowie No. 2 permit application. <br />20. On pages 2.04-36 and 2.04-37 reference to Map 10 has been removed and replaced with Maps IOA and <br />IOB. The upper perched water zone is described on Page 2.04-37 but it is unclear which map now shows <br />the Upper Perched Water Zone, if any. Under the heading Upper Perched Water Zone and Rollins <br />Sandstone please describe the upper perched zone and what map now depicts the potentiometric surface <br />of this water bearing zone. <br />This issue is resolved. Pages 2.04-32 through 2.04-38 were revised in the June 1, 2010 submittal. <br />21. It is unclear why the lower perched water bearing zone was not projected into the new mining area as <br />described on revised page 2.04-36 Since the available information indicates that the lower perched <br />water bearing zone lies above the B-Seam and could be impacted by B-Seam Mining in the new western <br />mine plan area, it should be projected into the new area. Please clam this and revise the permit text <br />accordingly. <br />This issue is resolved. Page 2.04-36 was revised in the June 1, 2010 submittal. <br />22. On revised page 2.04-46, there is a discussion of the gain-loss report on Terror Creek. Please add to <br />the discussion how the results of this report may have been impacted by current mining or may impact <br />future mining plans in the immediate area. Please include in the discussion references to the permit <br />application referring to monitoring on the surface and in the mine and mitigation plans if impacts to <br />Terror Creek are observed. In addition, please briefly discuss the gain-loss potential in the Mine <br />Water Inflow discussion on revised page 2.04-54. <br />This issue is resolved. BRL added text to revised page 2.04-46 of the June 1, 2010 submittal that <br />explains that the gain-loss study was performed before there was mining in the area. Therefore, the <br />gain-loss is baseline data and would not be related to mine water inflow. <br />23. Please revise Section 2.04.7(3) on revised pages 2.04-49 and 2.04-50 to include the possible impacts <br />from mining the B-seam. <br />This issue is resolved. The impacts from mining the B-seam were added to the discussion on revised <br />page 2.04-49 and 2.05-50 of the June 1, 2010 submittal. <br />24. In the second paragraph on revised page 2.04-50, should Terror Creek be included along with <br />Hubbard Creek and Steven's Gulch as creeks that will be protected from the effects of subsidence? <br />This issue is resolved. Revised page 2.04-50 was provided in the June 1, 2010 submittal. <br />25. On revised page 2.04-47, it is stated that stock pond P-1 is located in Steven's Draw in the southwest <br />corner of the permit area. With the additional acreage added in PR-12, the location of PR-12 is more <br />south centrally located. In order to avoid any confusion, please revise accordingly.
