Well Permit no. 52945-F <br />Sections 28 and 29, T3N, R67W, 6t' P.M. <br />Water Division 1, Water District 5, Weld County, Colorado <br />Approval Period: November 1, 2009 through October 31, 2010 JUL 0 7 LU10 <br />Contact Phone Number for Ms. Cheryl Signs: 303-778-7653 Division vi neciaination, <br />Mining and Safety <br />Dear Ms. Signs: <br />We have reviewed your letters dated October 9, 2009, January 22, 2010, March 31, 2010 and <br />June 23, 2010 requesting renewal of the above referenced substitute water supply plan ("SWSP") to <br />cover depletions caused by an existing gravel mining operation. The required fee of $257 for the renewal <br />of this substitute water supply plan has been submitted (receipt no. 3643119). The original plan was <br />approved on September 28, 1999 and it was most recently renewed on October 16, 2008. <br />Plan Operation <br />This plan seeks to replace depletions resulting from mining operations at the Kurtz Ranch <br />Resource and Recover pit ("Kurtz", WDID 0503002). The depletions that results from the mining <br />operations are evaporation, water lost in mined product, and dust suppression. The mine is located in <br />Weld County in parts of Sections 28 and 29, Township 3 North, Range 67 West of the 6`h P.M. This <br />SWSP will cover the replacement of the projected depletions of 259.38 acre-feet per year. The <br />replacement will be made using water stored in two lined pits. The storage water will be from the junior <br />storage water rights that were decreed in case no. 2001 CW274. The stored water decreed in case no. <br />2001 CW274 is also used in the Durham Pit SWSP (DRMS M78-056). <br />Depletions <br />The anticipated net depletions for this SWSP are 259.38 acre-feet per year. The currently <br />exposed groundwater at the site totals 19 acres. However, the plan anticipates that a total of 173.1 acres <br />of water surface will be exposed at the site if dewatering ceases. The evaporation calculations were <br />based on the entire exposed surface area in the event that the dewatering ceased and this plan will cover <br />replacements for depletions associated with the 173.1 acres. <br />You indicated that in addition to the dewatering pumps installed in the pit for dewatering, the <br />Applicant intends to use well no. 2489-FR, for dewatering purposes at the site. This well was decreed by <br />the Division 1 Water Court as Kurtz Well No. 11 in Case no. W-3873, for 1.84 cfs and irrigation purposes <br />of 50 acres in the NW1/4 of Section 28, Township 3 North, Range 67 West of the 6th P.M. The well is <br />located on the Kurtz site DRMS permitted boundary and the well has not been used for irrigation since <br />mining started at the Kurtz site.
