III. COMMENTS -COMPLIANCE <br />a - . Ili <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the McClane Canyon Mine conducted by Mike Boulay of the Division <br />of Reclamation, Mining and Safety on June 24, 2010. There was no operator/representative from <br />McClane Canyon Mine present during the inspection. I did speak with Gary Isaac Mine Manager at <br />the mine office prior to conducting the inspection. Weather conditions were sunny and warm and <br />ground conditions were dry. Coal was not being conveyed from the mine at the time of the inspection. <br />Haul trucks were running and coal was being loaded and hauled to the Cameo Power Plant. <br />Roads <br />Roads were maintained and in good condition throughout the site. Ditches and culverts were clear of <br />sediment and debris and functioning properly. <br />Hydrologic Balance <br />Drainage structures and diversion culverts in the portal area were clear of debris and functional. The <br />diversion structures are very well maintained at the portal facilities area. <br />The sediment pond was containing muddy water at approximately 1 foot below the level of the gated <br />principal spillway. The manually operated pond was not being discharged. The silt fences at the <br />entrance to the road accessing the construction material and topsoil pile locations and at the east side of <br />the bridge at East Salt Creek crossing were maintained. All site sediment control features appeared to <br />be in good working order and no problems were noted during this inspection. <br />Processing Waste <br />The temporary coal waste pile area is well maintained. Waste is adequately contained within the berm <br />surrounding the pile. The clean water diversion ditch around the waste pile and sediment storage area <br />is very stable and functional. <br />A large amount of coal waste material has been hauled from the site to the temporary coal mine waste <br />storage area atop the CRDA-1 pile at the Roadside Portals Mine. This has been previously approved <br />and is documented in the permit application packages for both McClane and Roadside Mines. Hauling <br />coal waste from McClane Canyon Mine has been completed. Approximately 2500 tons of coal waste <br />(coaly material and coal refuse) was hauled from McClane Canyon Mine to the temporary storage area <br />at Roadside Mine between June 17 and June 21, 2010.
