(Halliburton) holds <br />surface rights on certain land on which Snowcap Coal Company, Inc. (SCC) has <br />made application for a Phase I, II and III Bond Release for Mining and <br />Reclamation Permit No. C-81-041 with the Colorado Division of Reclamation, <br />Mining and Safety (DRMS). Halliburton's surface ownership within the permit <br />boundary includes the Unit Train Loadout and portions of the Overland Conveyor <br />Corridor and Rail Spur located in Sections 26, 27 and 34, Township 10 South, <br />Range 98 West, 6th P.M., Mesa County, Colorado. <br />As per DRMS's rule 4.15.10(3), Halliburton does hereby request that the <br />vegetation requirements of rule 4.15.10(2) be waived on those properties owned <br />by Halliburton, as described above, due to on going construction projects.
