<br />SOUTH ADAMS COUW r <br />WATER & SANrrATION DISTRICT <br />March 9, 2010 <br />Anne Best Johnson, AICP <br />Land Manager Northern and Metro Colorado <br />Lafarge North America, Inc.; Western U.S. Region <br />11409 Business Park Circle, Suite 200 <br />Longmont, CO 80504 <br />Re: South Adams County water anu am, <br />Tanabe Reservoir for Water Storage <br />Dear Ms. Johnson: <br />The purpose of this letter is to notify Lafarge North American, Inc (Lafarge) that South Adams <br />County Water and Sanitation District (SACWSD) hereby accepts Tanabe Reservoir as a <br />completed water storage facility, conditioned upon the successful termination of the mining <br />permit and related requirements, including all reclamation requirements, held by LaFarge for the <br />R67W in Adams <br />subject property. Tanabe Reservoir, located in the NW IA of Section 10, T2S, <br />County, is planned to become part of the northern gravel pit storage complex for use by <br />SACWSD and Denver Water. This notice of acceptance is for only the reservoir and the limited <br />buffer area immediately surrounding the pit. The ownership of the remaining portion of the <br />original Tanabe property is anticipated to be conveyed to Lafarge. <br />The acceptance is based upon the following information: <br />1. February 2, 2007 approval letter by the State Engineer's office representative David <br />Nettles P.E., of the lining of the Tanabe Gravel pit which meets the August 1999 State <br />Engineer Guidelines for Lining Criteria for Gravel Pits. A copy of this letter is attached. <br />2. July 31, 2008 Swale Grading Plan prepared by Tetra Tech for Tanabe Reservoir to <br />minimize dead storage capacity at the Tanabe Pit. A copy of this document is attached. <br />3. October 20, 2009 letter prepared by Tetra Tech noti57ng Dave Jordan the grading plan <br />has achieved its intended purpose bAl copy of this do utnent slalsol atgt a hed. ainage <br />to the northwest corner of Tanabe Reservoir. <br />Please note that SACWSD is not accepting responsibility for the active mining permit at <br />the site. SACWSD does support the closure of the mining permit associated with the <br />reclamation plan on this portion of the property. LaFarge has a continuing obligation to <br />complete reclamation of the subject property pursuant to all governmental permits, licenses, and <br />regulations governing the operations of LaFarge on the property and will retain the responsibility <br />for all maintenance, repair and clean-up associated with the subject property until final <br />acceptance.
