Mr. Dave Berry <br />We are again requesting the withdrawal of permit revision 6 and have it re-written to include <br />accurate terminology and stick to the facts of only what is needed for a permit revision and that <br />would all of this work and trying to rewrite.The permit revision would only be half of what it is <br />and everyone would be happy and life made simple. Trying to correct 600 pages is very difficult <br />and none of this is necessary for a permit revision. Does not have to be <br />irrigated. Grasses, legumes, hay, corn sunflowers, anything grown to harvest. <br />B) pastureland land which is for livestock grazing and may be occassionally hayed for <br />production. <br />© rangeland means land on which plant cover is principally valuable for forage. As you can see <br />in the choices that the rules and regulations governing the State of Colorado as well as the United <br />State, there is NO IRRIGATED terminology nor DRYLAND. The reason for this is because in <br />other parts of Colorado as well as the United States, there are places that have no irrigation and <br />therefore the laws must be written to cover ALL areas. <br />Land use is not the vegetation COVER but what the land has been used for. It has nothing to do <br />with HOW much water or How good or bad a person may think the farm is MANAGED because <br />a person may get 10 ton, 20 ton, 100 ton, etc and if it is being HARVESTED for production <br />irregardless of what that production may be, it is CROPLAND. Cropland does not have to be <br />prime soils, nor does it have to be irrigated nor does pastureland. <br />The reason why the State nor the Mine can add there own words to the rules and regulations is <br />because it changes the context of the meaning of each designation that was given for the benefit <br />of everyone, not just the ones that happen to live where there is irrigation water available. When <br />the rules and regulations are read, it applies to all the lands within the State and the United States. <br />Volume 2 <br />2.05.4 (2) © 6&7 The modified original topography on the WFC owned land is due to backfill <br />quantity limitations is imposed by previous mining at NEW Horizon 2 mine. It was never <br />previously mined and fragmented sentences and why is historically cropped land being allowed <br />as dryland? Dryland is not a choice as per rule 1.04.
