Box 628 1313 Sherman St., Room 215 <br />Nucla, Colorado 81424 Denver, CO 80203 <br />RE: New Horizon Mine, Permit No. C-1981-008 <br />Telephone 970/864-2165 Permit Revision No. 6, Response to Adequacy Review No. 3 <br />Fax 970/864-2168 <br />Dear Ms. Brown: <br />Accompanying this letter please find Western Fuels-Colorado, LU.'s (WFC) <br />response to the Permit Revision No. 6 (PR-06) Adequacy Review No. 3 that you <br />sent to us on June 21, 2010. Also enclosed you will find WFC's response to the <br />Morgan Property landowner representative's June 4, 2010 objection letters as you <br />directed in your June 21, 2010 letter. You will also find enclosed the letter <br />transmitting this package to the Morgan family which will be hand delivered by us <br />to them today. <br />WFC believes this response to Adequacy Review No. 3 to be complete and more <br />than adequate to answer the questions presented by the Division and the Morgans <br />with regard to restoring the prime farmland. We respectfully request that you <br />expedite the review of the PR-06 documents and issue a favorable decision on or <br />before August 15, 2010 so that stripping operations can resume on the Morgan <br />property. Failing that, we request that you approve the non-prime farmland <br />sections so that work can continue on the WFC and Lloyd family owned <br />properties. This would include approval of Pond 015 and collector ditches; topsoil <br />stripping, stockpiling and respreading; revegetation and other aspects of the <br />application that do not pertain directly to the Morgan property. <br />I will be away from Nucla and out of contact until July 19, 2010.
