The permit/affected <br />land boundary was marked with metal posts in a different configuration than what is currently <br />approved. The operator has mined and affected acreage outside of the marked permit boundary <br />and the actual approved boundary. Based the Division's measurements, it appears the Operator <br />has affected approximately 2.5 acres of land outside the current approved boundary. <br />June 11"', 2010 - A Reason to Believe letter and the Division's June 1', 2010 inspection report <br />was sent to the Mr. Ray Sikes of Carrizo Stone, LLC. <br />REASON FOR YIOLATION: <br />The Operator has affected approximately 2.5 acres outside of the approved permit boundary- It <br />is the Operator's responsibility to obtain a reclamation permit prior w engaging in a new <br />operation. <br />STAFF RECOMMENDATION., <br />Violation: <br />Find a violation of C.R.S. 34-32.5-109 (1) for failure to first obtain from the board or <br />office a reclamation permit prior to engaging in a new operation.
