Pineda <br />Mining and SOely Director <br />Re: Ruby Trust Mine, Permit No. M-1979-181, Amendment AM-1, Complex Application, Extension of <br />Decision Date. <br />Dear Ms. King, <br />On May 24, 2010, the Division of Reclamation, Mining and Safety formally received the 110(2) Permit Amendment <br />Application AM-1 for the Ruby Trust Mine. The decision date for your amendment application was set for June 23, <br />2010. Technical review of the amendment application has revealed numerous items that must still be addressed before it <br />can be considered adequate for approval pursuant to the Act and Rules. Additionally, the hydrologic and metallurgic <br />portions of the information provided in the application are sufficiently complex to warrant extending the decision date to <br />allow additional time for the Division's review. <br />Pursuant to Section 34-32-115(2) of the Hard Rock/Metals Act, the Division may extend the decision date up to sixty <br />(60) days for complex applications. At this time, while we do not believe that the entire sixty days of additional time will <br />be necessary to find the amendment application adequate for approval, the Division nevertheless is extending the date by <br />the maximum of sixty days. The application may be approved at any time prior to the extended decision date if it is <br />found to be adequate. <br />The decision date for the amendment application is therefore reset to August 23, 2010.
