An augmentation station must be constructed in order to provide a means of measurement <br />acceptable to the Division Engineer and Water Commissioners to quantify the amount of <br />replacement water delivered to Arkansas River, after direct diversion through the Lester <br />Attebery Ditch. Construction of an augmentation station shall be equivalent to a parshall <br />flume with a continuous recorder. <br />5. The current flume for measuring the diversions of the Lester Attebery Ditch is not in <br />compliance with the provisions set forth in C.R.S. § 37-84-112. A new flume must be <br />constructed at a more suitable drop site, preferably west of Colorado Highway 115 <br />upstream from the current location, within 60 days. Failure to comply could result in an <br />Order of the Division Engineer and failure to comply with any Order of the Division <br />Engineer will result in potential fines and fees. <br />6. Applicant shall record a copy of this approval letter, a copy of the 40 acre area monumented <br />to be dried up, and a copy of the stock certificate for the 60 shares of Twin Lakes Reservoir <br />and Canal Company with the Fremont County Clerk and Recorder's Office. The 60 shares of <br />Twin Lakes dedicated to this plan may not be sold, leased or otherwise legally encumbered <br />during the term of this plan. <br />7. Adequate accounting of depletions and replacements (in acre-feet) must be provided to the <br />water commissioner (Brian. Sutton Ca_state.co.us) and the division engineer <br />(Div2Ground.Water@state.co.us) on forms and at times acceptable to both of them. The <br />accounting form(s) shall be sufficient to demonstrate that the net effective replacement <br />equaled or exceeded the total depletion on a monthly basis. All replacement water must be <br />concurrent with depletions in quantity, timing and location, except that releases aggregated <br />at the discretion of the division engineer ma,, occur in a later month than the depletions. <br />Said accounting must be received by the 10 h of the month following the reporting period. <br />8. For all sources of dry-up the following conditions apply related to fields containing alfalfa: <br />a. Credit from dry-up fields containing alfalfa will be assessed in the following manner: <br />For fields deep tilled or chemically treated to kill alfalfa, 100% credit will be <br />given for consumptive use as otherwise computed under the conditions of <br />this approval. <br />For fields not deep tilled or chemically treated to kill alfalfa, records of <br />monthly monitoring of depth to groundwater at existing irrigation wells or <br />existing or new monitoring wells or piezometers within %-mile of each alfalfa <br />field and capable of measuring ground water levels to a depth at least 8 feet <br />below the lowest point of elevation of the field must be maintained. The <br />wells or piezometers to be used must be identified and located by UTM <br />coordinates. <br />Credits will be reduced according to the following table when depth to groundwater <br />is less than the depth assumed to provide no significant contribution to alfalfa <br />growth. Measurements of depth to ground water shall be recorded on forms <br />acceptable to the Division Engineer and submitted to the Division Engineer's Office <br />by the 1 0th of each month.
