MINE ID # / PROSPECTING ID #: M-1977-315 <br />INSPECTOR'S INITIALS: MAC <br />INSPECTION DATE: June 15, 2010 <br />OBSERVATIONS <br />The inspection was conducted by Michael Cunningham of the Division of Reclamation, Mining and Safety <br />(Division). Carl Hill of Bestway Paving was also present for the inspection. The Pit No. 1 site is located in <br />Greeley, Colorado. The site is permitted for 38.7 acres and the post-mining land use is industrial/commercial. <br />This inspection was conducted in response to a request for a full performance and financial warranty release <br />received by the Division on May 18, 2010. The site was last inspected on June 21, 2005 in response to a full <br />performance and financial warranty release request. The request was denied due to a lack of established <br />vegetation on the pit slopes. In addition, the Permittee had not provided the Division with reasonable assurance <br />the site would be developed into a residential development as required by Rule 6.4.5(2)(b). <br />The pit slopes have been graded to 3H:1 V and do not show any signs of erosion. Vegetation has established on <br />the pit slopes; the dominant grass species is crested wheatgrass. Several buildings are present near the north <br />permit boundary; the presence of these buildings are in line with the post-mining land use and their removal is not <br />required. A small stockpile of asphalt material is located near the center of the site and a stockpile of dredged <br />material is located near the south permit boundary. The stockpiles are stable and will be utilized during the <br />development of the site. The previous release request was denied in part because the Division did not have <br />assurance that future plans to develop the site would be executed. The Permittee provided the Division with a <br />letter from the City of Greeley, approving the proposed subdivision plat for Pit No. 1. <br />Based on the observations of this inspection, the Operator has satisfied the requirements of the reclamation <br />performance standards outlined in the Construction Materials Rules and Regulations. The request for a full <br />performance and financial warranty release will be approved. <br />The Division currently holds a financial warranty in the amount of $61,025.00.
