Hamrick, VP Milling <br />-rD Cotter Corporation <br />P.O_ Box 175 <br />Canon City, CO 81215 <br />OF <br />H <br />t <br />? rs7g ? <br />Colorado Department <br />IPWW of Public Health <br />and Fnvironment <br />RE: Notice of Violation/Cease and Desist Order, Number: I0-100601-1 i/ <br />Cotter's June 26, 2010 Plan for Interim Measures at Schwartzwalder Mine <br />Dear Mr. Hamrick: <br />The Colorado Department of Public Health and Environment's Water Quality Control Division (the <br />"Division") received Cotter Corporation's ("Cotter") June 26, 2010, plan and expedited time <br />schedule for the implementation of interim measures that Cotter will implement to reduce or <br />mitigate the concentrations of pollutants in the unauthorized discharge at Schwartzwalder Mine. <br />The plan and time schedule were submitted in response to paragraph 27 of the Notice of <br />Violation/Cease and Desist Order, Number: I0-100601-1 (the "NOV/CDO"), that the Division <br />issued to Cotter on June 1, 2010. <br />The Division hereby authorizes Cotter to discharge from the temporary 50 gpm water treatment <br />system in accordance with the submitted plan and time schedule and the following alternate and <br />additional terms and conditions: <br />1. Cotter shall perform weekly Radium 226+228 monitoring, as opposed to the monthly frequency <br />proposed in the submitted plan and time schedule. <br />2.
