Kaldenbach, Tom <br />From: Kaldenbach, Tom <br />Sent: Tuesday, May 25, 2010 2:52 PM <br />To: Hernandez, Daniel <br />Subject: Coal Gulch Mine (C-84-067), Phone conversation with Jim Fulton <br />Dan, <br />During the Coal Gulch surety release/termination of jurisdiction inspection on 5/18/10, Jim Fulton of OSM and I briefly <br />discussed the possibility of using civil penalty money for funding breaching of the pond embankment on the site. After <br />closer inspection we both recognized the embankment appeared structurally and erosionally sound, and the open <br />channel earthen spillway can be expected to function adequately if the pond fills. I just confirmed with Jim in a phone <br />call that he has no concern with the pond embankment remaining as a permanent feature as currently constructed. <br />Also, I explained in the phone call that in the past OSM has not provided DRMS a concurrence letter on termination of <br />jurisdiction of private revoked permit sites, and I requested a copy of any inspection report OSM prepares for the <br />inspection. He said he would let Christy know that a concurrence letter is not needed and would ask to her to provide <br />DRMS a copy of her report.
