Pineda <br /> Director <br />RE: Twentymile Coal Company, Permit C-82-056 <br />April 2010 Discharge Monitoring Report Review (Permit CO-0027154) <br />April 2010 Discharge Monitoring Report Review (Permit COG-073311) <br />Dear Mr. Watterson, <br />The Colorado Division of Reclamation, Mining, and Safety (CDRMS) has reviewed and found the <br />above referenced reports to be in compliance with Rule 4.05.13(2). The May 2010 Discharge <br />Monitoring Reports for the above referenced CDPS Permits were received by the Division on 29 June <br />2010; the reports cover the time period from 01 May 2010 through 31 May 2010. <br />Permit CO-0027154 - Outfalls 005A/MON5/005W (Pond D), 003A (Pond B), 002A (Pond T), <br />007A/MON7/007W (Pond F), 008A (Pond G) and 006A (Pond E) discharged during May 2010. No <br />exceedances of any compliance criteria were noted during the month. Outfall 004A did not discharge <br />during the month noted. <br />Permit COG-073311 - Outfall 001A (Fish Creek Construction Crossing) discharged during the month <br />of May 2010. Two exceedances were noted relating to TSS, 30-day average and maximum. <br />It is noted that based on a Memorandum of Understanding between the Division of Reclamation, <br />Mining and Safety and the Water Quality Control Division (WQCD), the WQCD will be responsible <br />for enforcing CDPS permit conditions including exceedances of TSS. <br />Thank you for the timely submittal. <br />If you have any questions feel free to contact me.
