This initiative was directed
by the Water Quality Control Division of CDPHE in Paragraph 27 of the Notice of
Violation/Cease and Desist Order, Number: I0-100601-1 (Order) issued to Cotter on June 1,
2010. It is our understanding that the appropriate mechanism for DRMS to approve this interim
measure is to submit a new Technical Revision request. A check for $1,006 has been sent under
separate cover.
Please accept the enclosed rationale and request for Technical Revision 13 to Permit M-1977-
300 for temporary 50 gpm nominal water treatment to remove uranium from water reporting to
Sump Number One at the Schwartzwalder Mine. Cotter plans to initiate this interim (50 gpm)
mitigation measure by July 3, 2010 with operations to continue until the planned 100 gpm water
treatment system at the water treatment building becomes operational (scheduled for July 31).
If you have any questions, please contact me at 719-275-7413 (Ext. 202) or 303-332-1504.
Sincerely,
John S.
