Box 628 <br />Nucla, CO 81424 <br />RE: New Horizon Mine, Permit No. C-1981-008 <br />Permit Revision No. 6 <br />Dear Mr. Wade: <br />COLORADO <br />DIVISION' OF <br />RECLAMATION <br />MINING <br />SAFETY <br />The Division of Mining Reclamation and Safety (Division) received Western Fuels-Colorado (WFC) request <br />for an extension to the proposed decision for Permit Revision No. 6 (PR-06) until July 2, 2010 at 12:00 noon. <br />WFC agrees to limit operations in the prime farmlands to the active pit on the Morgan Property. WFC will <br />only complete drilling, blasting, overburden and coal removal from those areas already stripped of topsoil and <br />"Bench 1" material. No further topsoil removal, Bench 1 removal, grading, topsoil replacement or seeding <br />will occur on the prime farmlands. <br />With this agreed limitation in place the Division will extend the deadline as requested. <br />Sincerely, <br />Sandra L.
