III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division). Activities are focused mainly on the immediate <br /> surface facilities around the site including the refuse conveyor, the preparation plant, and <br /> general maintenance. Ground conditions during portions of the two days onsite were dry and <br /> the weather was clear and hot. <br /> Availability of Records <br /> The public copy of the mine records is kept at the New Elk Coal Company (NECC) office <br /> located at 122 West First Street, Trinidad CO, 81082, 719-845-0090. Ron Thompson, mine <br /> manager for NECC, was present during the records inspection. All records were found in <br /> compliance as detailed on page 2a of this report. <br /> Signs and Markers <br /> The operator has located disturbed area markers and will be repainting the tops of the <br /> markers in the immediate future. The mine identification sign is accurate and posted as <br /> required at the mine entrance. One sign posted at the gate located south of Highway 12 and <br /> across from the Pond 8 access road lists "Picketwire Processing, LLC' as the permittee. <br /> Another sign identifying the MSHA id at Pond 8 reads "Wyoming Fuels". The operator should <br /> ensure that the signage site-wide accurately reflects the mine ownership and control. <br /> Hydrologic Balance <br /> Pond 7 remains nearly full. The outlet gate was closed. Water in the pond appears to be <br /> reasonably clear and may be ready for manual discharge. If the water I the pond will meet <br /> applicable effluent limitations, the operator should discharge the water resident in the pond <br /> and bring the pond into compliance with the approved plan (see approved permit page 2.05- <br /> 10a). As noted in last month's report, the operator should review the field condition and <br /> maintain the emergency spillway as necessary. <br /> Pond 001 is the mine water discharge pond, located immediately north of the mine office. <br /> The pond water level is now 2-3 feet below the discharge point and water was not observed <br /> being pumped to the pond at any time during the two days of inspection. <br /> Pond 8 is dry. The pond was been recently cleaned of sediment delivered from runoff mainly <br /> from the exposed surface of the Refuse Disposal Area. Sediment survey results should be <br /> submitted with quarterly sediment pond reporting. <br /> Support Facilities <br /> Contractors are onsite working on the refuse conveyor, the prep plant, and general <br /> maintenance activities, preparing for coal development and production. A small transfer <br /> conveyor and feeder breaker(orange arrow)for transport of development waste to the RDA <br /> conveyor (blue arrow) is nearly complete. <br /> 3 <br />
