Permit C-81- <br />019 <br />To Whom It May Concern, <br />Colowyo Coal Company L.P. is submitting an application for Phase III Performance <br />Bond Release on parts of its 1978-1999 reclaimed areas. Phase III bond release is <br />the final bond release on reclaimed lands. Areas considered for Phase III bond <br />release have already been Phase I and II released, meaning backfilling and grading, <br />establishment of drainages, topsoil placement and seeding have already been <br />examined by the State and deemed in compliance with the approved reclamation <br />plan. Phase III bond release focuses on revegetation success, functionality of the <br />area's post-mining land use, erosional features, surface and groundwater impacts <br />and completion of all reclamation obligations. These reclaimed areas must also <br />have had a minimum of ten years of growth and maintenance. <br />This written notice is sent to you pursuant to Colorado Division of Reclamation, <br />Mining and Safety (CDRMS) Rule 3.03.2(1).
