Pineda <br />Director <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 118, <br />Paragraph 3, of the Colorado Revised Statutes, that on June 28, 2010, an application to revise coal mining operations at the <br />Seneca II Mine was considered complete for the purposes of filing. All review and comment periods as provided in the Act and <br />the Regulations initiate from this date of filing. <br />This revision application proposes a reduction in size of the Seneca II permit boundary. The proposed reduction is to <br />accommodate the new Peabody Sage Creek Mine (PSCM) permit area, which will incorporate approximately 3, 011.9 acres of <br />the original Seneca II permit area. The revised Seneca II permit area will retain 386.5 acres of the original permit area that <br />includes 271.0 disturbed acres. The revised Seneca II mine permit boundary encompasses one isolated watershed and separates <br />runoff from the Seneca II mine and the new PSCM permit area. The watershed discharges to pond 008, which is an approved <br />NPDES discharge point. Proposed changes to the current permit boundary and associated changes to the operations and <br />reclamation plans are set forth in a new volume to the permit application package titled "Permit Revision (PR-02) reduced <br />permit area. <br />The surface coal mining operation is on land located approximately 9 miles Southeast of Hayden, Colorado. The permit area is <br />further described as follows: <br />T5N, R87W; All of Sections 1, 2 and 12; Portions of Sections 3, 11 and 13 <br />T6N, R87W; Portions of Sections 27, 34, 35 and 36 <br />T5N, R86W; Portions of Sections 6 and 7. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Milner & Mount Harris. <br />Mining operations have been completed within the proposed reduced permit area, the entire area has been backfrlled, topsoiled, <br />and seeded, and Phase I bond release has been approved. Continuing activity during the liability period will be limited to <br />monitoring and maintenance. Certain modifications to the approved revegetation success demonstration and success standards <br />have been proposed in the application, in association with the reduced permit acreage proposed. <br />The revision application and the currently approved permit application can both be viewed on laser fiche on the DRMS website <br />(http://www.mining.state.co.us/ImaizedDocuments.htm). The revised maps and narrative can be found in the revision index <br />class, while the currently approved narrative and map are in the permit file index class. To access the revision materials, click <br />on the class, then scroll down to the type and sequence and enter "PR2". <br />The applicant is required to publish notice in a local newspaper that this application has been deemed complete.
