The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33,
Section 116, Paragraph 4, of the Colorado Revised Statutes, that on June 28, 2010, an application to revise coal
mining operations at the Seneca H Mine was considered complete for the purposes of filing. The revision was
submitted by Seneca Coal Company, LLC. All review and comment periods as provided in the Act and the
Regulations initiate from this date of filing.
This revision application proposes a reduction in size of the Seneca H permit boundary. The proposed reduction is
to accommodate the new Peabody Sage Creek Mine (PSCM) permit area, which will incorporate approximately 3,
011.9 acres of the original Seneca H permit area. The revised Seneca II permit area will retain 386.5 acres of the
original permit area that includes 271.0 disturbed acres. The revised Seneca H mine permit boundary encompasses
one isolated watershed and separates runoff from the Seneca H mine and the new PSCM permit area. The
watershed discharges to pond 008, which is an approved NPDES discharge point. Proposed changes to the current
permit boundary and associated changes to the operations and reclamation plans are set forth in a new volume to
the permit application package titled "Permit Revision (PR-02) reduced permit area.
The surface coal mining operation is on land located approximately 9 miles Southeast of Hayden, Colorado. The
currently approved permit area is described as follows:
T5N, R87W; All of Sections 1, 2 and 12; Portions of Sections 3, 11 and 13
T6N, R87W; Portions of Sections 27, 34, 35 and 36
T5N, R86W; Portions of Sections 6 and 7.
All west of the 6"' Principal Meridian.
The reduced acreage permit area as proposed in the PR-2 application is described as follows:
