Current, Previous, and Pending Coal Mining Permits Held by Seneca Coal Company and
<br />Peabody Investments Corporation
<br />Seneca Coal Company currently holds three coal mining permits in the United States. Two of
<br />these permits, C -80 -005 for Seneca II Mine and C -82 -057 for Seneca Il -W Mine, were
<br />transferred from Peabody Coal Company to Seneca Coal Company on October 17, 1994. The
<br />third permit, C -94 -082 for Yoast Mine, was issued to SCC on August 7, 1995. Current,
<br />previous, and pending mining permits obtained by Seneca Coal Company and its principal
<br />shareholders are listed in Appendix 3 -5.
<br />Legal Owners of Record of the Surface, Coal Oil Gas and Other Minerals The following lists the
<br />owners of record of the surface, coal, oil, and gas, and other minerals within the permit area of the
<br />Yoast Mine. Exhibits 3 -1, 3 -2 and 3 -3 depict the areas associated with these ownerships. Appendix 3-
<br />2 provides an alphabetical listing of the owners and their addresses. Appendix 3 -3 lists the ownership
<br />by legal description as recorded at the Routt County Courthouse.
