Per Rule 5.02.2(2) The Division shall conduct an average of at <br />least one complete inspection per calendar quarter of each active and inactive surface coal mining and <br />reclamation operation under its jurisdiction. . <br />The Seneca operations now fall under the inactive classification per Rule 5.02.2(4) For the purposes of this <br />section, an inactive surface coal mining and reclamation operation is one for which: <br />(a) The Division has secured from the permittee the written notice provided for under Section 4.30 of these <br />regulations. <br />This letter of request hereby provides the written notice. <br />SCC ceased mining coal in February 2006. Reclamation activities have been in progress since that time. All <br />final pits have been permanently backfilled and graded and the majority of the areas have been topsoiled and <br />seeded. The areas remaining to be topsoiled and seeded are small isolated disturbances, pond areas not yet <br />approved as permanent, and various entrance and access roads not yet narrowed to final configuration. The <br />on-going reclamation efforts consist of rill and gully maintenance, permanent drainage channel maintenance, <br />revegetation and stabilization of associated disturbance. <br />Phase I bond release has been approved for 100% of the Seneca II mining area, 89% of the Yoast mining area, <br />and 62% of Seneca II-W mining area.
