III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This partial inspection of the King Coal 1 and 2 Mine was conducted by DRMS staff from the Durango <br /> Office, located at 691 County Road 233, Suite A-2, Durango, CO 81301, phone (970)247-5469. <br /> Operations were active at the King Coal 2 Mine. The Operator has commenced final reclamation for <br /> portions of the King Coal 1 Mine area. Nine photos and copy of the AVS Annual Review Inspection <br /> Worksheet accompany this report. <br /> AVS Annual Review -The mine identification sign posted at the entrance to the King Coal 2 Mine is <br /> shown in photo one. Tom Bird was interviewed during the inspection and verified that the Permittee <br /> and Operator were GCC Energy, LLC, and that the MSHA identification number was 05-04864. The <br /> information provided by Mr. Bird was consistent with the information provided on the mine <br /> identification sign posted at the King Coal 2 Mine. The old sign posted at the King Coal 1 Mine <br /> appears to display obsolete information. <br /> King Coal 2 Mine—Operations were active at the King Coal 2 Mine. Sediment pond appeared dry. <br /> Pond embankment appeared stable and showed no evidence of slumping, seeping or excessive <br /> erosion. Primary and secondary spillways appeared intact and functional. Evidence of affected area <br /> drainage escaping the sediment containment structures was not observed. <br /> King Coal 1 Mine - Sediment Pond 1was holding water. Water depth was visually estimated at one <br /> foot and well below discharge elevation. Pond embankments appeared stable and showed no <br /> evidence of slumping, seeping or excessive erosion. Primary and secondary spillways appeared clear <br /> and functional (photo 4). As shown in photos five through eight, the two portals have been closed by <br /> backfill. Stockpiles of dismantled equipment were numerous, evidence of advancement towards final <br /> reclamation. The Operator indicated that the refuse disposal pile will remain active at the King Coal 1 <br /> Mine.
