In order for the financial warranty to be completely <br />waived for these areas, the applicant must commit to obtaining SEO certification of the slurry wall prior to <br />exposing ground water. Please specifically identify which cells the Operator intends the financial warranty to be <br />waived for slurry wall construction. <br />The applicant commits to not exposing groundwater in the unmined areas until the slurry wall has been installed. <br />The applicant also commits to obtaining SEO certification of the slurry wall prior to exposing groundwater. We <br />intend for the financial warranty to be waived for Cells A, C2, D1 and D2. We would like to use the 20% bonding <br />option for Cells C1 and B. <br />6.4.15 EXHIBIT 0 - Owner(s) of Record of Affected Land (Surface Area) and Owners of Substance to be <br />Mined <br />38) Please clarify, does Gilcrest Reservoir, LLC own the entire property located within the permit boundary? <br />Yes, Gilcrest Reservoir, LLC currently owns the entire property located within the permit boundary. However, <br />the ten-acre parcel with the residence in the southeast comer of the property will be transferred to Rocky <br />Hoffschneider Junior in the near future. We will be requesting that the Division release the ten-acre parcel from <br />the permit boundary after the subdivision and ownership transfer are finalized. <br />6.4.19 EXHIBIT S - Permanent Man-Made Structures <br />39) Please submit a list of permanent Man-Made Structures on or within 200 feet of the affected land.
