CIVIL RESOURCES, LLC <br />ENGINEERS & PLANNERS <br />June 22, 2010 <br />Mr. Jared Ebert <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />RE: S & H Mine; DRMS File No. M-2000-158; Amendment 02, Adequacy Review #1 <br />Dear Mr. Ebert, <br />Following is our response to your adequacy review letter dated April 20, 2010. <br />6.4 SPECIFIC EXHIBIT REQUIREMENTS - REGULAR 112 OPERATIONS <br />6.4.1 EXHIBIT A - Legal Description <br />1) The legal description must identify the affected land and be wholly adequate for field location of the property. It can <br />be in the form of metes and bounds survey or a description by reference to township, range and section to at least <br />the nearest quarter quarter section. Where applicable, the street address or lot numbers may be used. <br />The legal description was included in the amendment application. However, we have amended the legal <br />description based on comment #2 below. Please refer to Exhibit A for the revised legal description. <br />2) The last sentence on Exhibit A indicates a 10 acre lot in the southeast comer of the property will no longer be <br />included in the permit boundary. Based on the Exhibit C map, the permit boundary excludes this portion of the <br />permit area. This portion of land is currently included in the permit boundary and has not been release by the <br />Division thus must be included in the total permit acreage. This may change your intended total permit acreage by <br />10 acres, however this is not clear. Please revise all of the maps and text to include this portion of the permit area. <br />We will request a release for this ten-acre parcel from the Division. In the meantime, we have revised the map <br />and the legal description to keep the parcel within the permit boundary. <br />6.4.3 EXHIBIT C - Pre-mining and Mining Plan Map(s) of Affected Lands <br />3) These maps must be signed by the registered land surveyor, professional engineer or the qualified person who <br />prepared them. <br />Please refer to attached Exhibits C (Mining Plan Map) and F (Reclamation Plan Map). <br />4) The Exhibit C map is missing the following information: <br />a) All adjoining surface owners of record. <br />b) Please display and label the Western Mutual Ditch. <br />c) Please clearly display the permit boundary. It is unclear where the permit boundary will be located <br />especially in the north and northwest portion of the permit area. <br />d) Based on the Division's records for this site, there are numerous fences, buildings, houses, barns, water <br />wells, power lines, oil tanks, gas wells, other gas facilities and several protected monuments located on and <br />or within 200 feet of the affected land. All of these structures will need to be portrayed clearly on the new <br />Exhibit C map.
