Colorado water law is based on the prior appropriation doctrine, which states
that the first appropriator in time has the first priority to take and apply water
to beneficial use without waste. The right to divert the unappropriated waters
of any natural stream to beneficial uses is never to be denied under
Colorado's constitution; the Colorado water courts grant decrees to use
water and set priorities. The Colorado State Engineer and the Division of
Water Resources administer the water rights according to the priorities,
measure flows, and record the use of water. Colorado's compact
apportionment can be derived from many river sources, including the
Mancos River, into which Mud Creek flows.
References:
httr)://cfpub.epa.aov/surf/huc.cfm?huc code=14080107
htto://bioloav.unm.edu/stacev/Functional%20Assessment%20of%20the%20MancQM
0River%20Watershed.ndf
httr)://www.usbr.aov/uc/library/envdocs/ea/mancos valley/
State databases: httr)://165.127.23.41/website/Ittools/index.asr)?iw=800&ih=600
httr)://165.127.23.41-StatelMS (Colorado's Decision Support Systems)
2 httr)://tinvuri.com/27byyc2l accessed JUN 2010.
Exhibits for 112(c) AM-02 Application- M-1994-108-2010- Page 43
