STAFF SUMMARY FORM FOR <br />CONSENT AGENDA ITEMS <br />Date July 12 , 2010 O erator Carrizo Stone, LLC. <br />Permit No. M-2005-067 Site Name Carrizo Stone North <br />Specialist Jared Ebert Objecting Par N/A <br />Type of Action: <br />Action Check <br />Permit application with objections <br />Violation X <br />Extension of Board-ordered deadline <br />Other (specify). <br />Resolution: <br />NATURE OF VIOLATION.' <br />This item is in regards to a Notice of a Possible Violation, Cease and Desist Order, Corrective <br />Actions and Civil Penalties for a possible violation of C.R.S. 34-32.5-109 (1) for failure to first <br />obtain from the Board or Office a reclamation permit prior to engaging in a new operation. <br />CHRONOLOGY.- <br />June 1St, 2010 -- The Division conducted a monitoring inspection of the site. The permit/affected <br />land boundary was marked with metal posts in a different configuration than what is currently <br />approved. The Operator has mined and affected acreage outside of the marked permit boundary <br />and the actual approved boundary. Based the Division's measurements, it appears the Operator <br />has affected approximately 2.5 acres of land outside the current approved boundary. <br />June 11th, 2010 - A Reason to Believe letter and the Division's June l', 2010 inspection report <br />was sent to the Mr. Ray Sikes of Carrizo Stone, LLC. <br />REASON FOR VIOLATION.- <br />The Operator has affected approximately 2.5 acres outside of the approved permit boundary. It <br />is the Operator's responsibility to obtain a reclamation permit prior to engaging in a new <br />operation. <br />STAFF RECOMMENDATION.: <br />Violation: <br />Find a violation of C.R.S. 34-32.5-109 (1) for failure to first obtain from the board or <br />office a reclamation permit prior to engaging in a new operation.
