STAFF SUMMARY FORM FOR <br />CONSENT AGENDA ITEMS <br />Date July 12 , 2010 O erator Carrizo Stone, LLC. <br />Permit No. M-2006-024 Site Name Carrizo Stone South <br />S ecialist Jared Ebert Obiectin Par N/A <br />Action: <br />Action Check <br />Permit application with objections <br />Violation X <br />Extension of Board-ordered deadline <br />Other (specify). <br />Resolution: <br />NATURE OF VIOLATION. <br />This item is in regards to a Notice of a Possible Violation, Cease and Desist Order, corrective <br />actions and civil penalties for a possible violation of C.R.S. 34-32.5-116 (4) (i) for failure to <br />protect areas outside of the affected land from slides or damages occurring during the mining <br />operation. <br />CHRONOLOGY.- <br />June 1St, 2010 - The Division conducted a monitoring inspection at the site. It was noted the <br />Operator has constructed a processing area outside of the southern permit boundary containing a <br />sandstone saw, and a metal storage container used for the operation. This disturbance was <br />estimated to be about .3 acres. This processing area is considered "Affected Land" as defined by <br />Rule 1.1 (3) and must be contained in the permit area. <br />June 1 lth, 2010 - A Reason to Believe letter and the Division's June 1St, 2010 inspection report <br />was sent to the Mr. Ray Sikes of Carrizo Stone, LLC. <br />REASON FOR VIOLATION: <br />The Operator has affected approximately .3 acres outside of the approved permit boundary. It is <br />the Operator's responsibility to protected areas outside of the affected land from slide or damages <br />occurring during the mining and reclamation operation in accordance with C.R.S. 34-32.5-116 (4) <br />(i). <br />STAFF RECOMMENDATION.- <br />Violation: <br />Find a violation of C.R.S. 34-32.5-116 (4) (i) for failure to protect areas outside of the <br />affected land from slides or damages occurring during the mining operation.
