4 <br />-2- <br />The mine is noted as having intermittent status. This means there is a potential the site will be active for less <br />than 180 days per year. However, Nuvemco must maintain all EPP requirements regardless of any other <br />activities. <br />• Construction of all storm water control measures and retention berms must be done prior to any additional <br />activities on site. <br />• DRMS request a 30 day written notice prior to activation of mining operations. <br />• Permit and affected area boundaries must be clearly identified prior to site activities. <br />• DRMS has calculated a final reclamation liability estimate based on the proposed mine and reclamation plans. <br />The estimate has established the reclamation warranty for the site is $45,250.00. <br />DRMS notes the Uncompahgre Field office of the Bureau of Land Management (BLM) is currently finishing its process <br />for a Plan of Operation for the mine. BLM per a MOU must concur on the bond amount established by DRMS. Note <br />that no disturbance can occur on site until all other local, state and federal permits required have been approved and <br />issued. The release process of the bond for the Notice of Intent will be sent by separate cover. <br />Per Rule 4.1(2) an operator has 365 days from the approval date to have accepted a performance and financial <br />warranty. Based on the June 9, 2010 MLRB approval date, Nuvemco has until June 9, 2011 for acceptance of the <br />warranties. Please note failure to have the bonds accepted by that date will require a MLRB hearing, re-publication of <br />the public comment period and possible denial of the permit.
