K? <br />r Notice of Intent to Explore <br />Lorencito Bulk Coal Sample <br />MGP Mineral Enterprises LLLP <br />June 17, 2010 <br />which is developing and producing coal bed methane in the area. If any of the <br />endangered or threatened species are observed during the drilling, drilling will be <br />stopped to minimize any impact on the specie. <br />Also, the permit application file contained a statement that "No sensitive species of <br />plants were observed during the field investigation of the property. Little suitable <br />habitat occurs within the permit area for Smith Whitlow-grass (Draba smithii), <br />Colorado green gentian (Frasera coloradensis), and sandhill goosefoot (Chenopodium <br />cycloides). Therefore, the proposed project is not expected to directly adversely affect <br />any individual or populations of these sensitive plants and is not likely to result in a <br />downward trend toward federal listing." Additionally, the drill holes will be located <br />on areas that are already disturbed by the construction and maintenance of the roads in <br />the area. If any of the species of plants listed above are observed, care will be taken to <br />ensure that the plant and the area around the plant is not disturbed. <br />Page 3
