1 <br />i <br />.10 <br />Lorencito Bulk Coal Sample <br />MGP MINERAL ENTERPRISES LLLP <br />June 17, 2010 <br />Responses to Questions in Notice to Explore Involving removal of 250 tons or less of coal <br />3. MGP MINERAL ENTERPRISES LLLP (MGP) received a quit claim deed from <br />Robert G. Parsons and others dated June 10, 1974 in Book 759, Page 474 in Las <br />Animas. County Records granting MGP the mineral rights along with "free and <br />uninterrupted right of way into, on, and under the above-described lands at such points <br />and in such manner as may be proper and reasonably necessary for the purpose of <br />digging, exploring, operating, and developing such land for such minerals, and <br />producing, removing, storing, treating, handling, transporting, and marketing the same <br />therefrom, including but not limited to (a) the right to mine, drill, remove and transport <br />such minerals with liability for any injury that may result to the surface or to any <br />overlying strata..." A copy of the quit claim deed is attached. <br />4. The drilling will be performed within the area already disturbed by roads already <br />constructed in the area for the rancher or for the coal bed methane drilling. No topsoil <br />is present at each site and no vegetation is present on the drill site. The topography at <br />each drill site is nearly flat. <br />5. An exploration drill rig will be used to plug drill to just above the Primero Coal Seam <br />and then core the Primero Coal Seam. The drilling will be performed with <br />recirculating water with drilling mud using a dug pit adjoining the drill hole. The dug <br />pits will be filled and graded level following completion of the drilling. No road <br />access or construction will be performed as all drilling will be performed on existing <br />roads or road disturbance areas. Also, no topsoil is present to be removed. A front- <br />end loader/backhoe will be on site to dig the dug pit, to fill the dug pit on completion <br />of the drilling, and level the area of the drill site upon completion of drilling. Up to <br />three drill holes will be drilled with a maximum of three drill holes at a site. <br />b. Specifically address: <br />1) None. <br /> <br />2) None. <br />Page 1
