Completion of drilling, blasting, overburden and coal <br />removal from those areas already stripped of topsoil and "Bench 1" material (as of the dated of this <br />letter). No further topsoil removal, overburden removal, backfilling, grading, topsoil replacement or <br />seeding is to occur on those prime farmlands. Mining and reclamation activities will be limited to areas <br />north of the Morgan property until final resolution of the issues listed in this letter. <br />The organization of the permit has created difficulties in our review. Some topics, such as topsoil <br />handling, are addressed in multiple sections creating inconsistencies and confusion. For those sections <br />we have asked WFC to provide a comprehensive plan and eliminate duplicity throughout the permit. <br />Rule 2.03.4 - Identification of Interests <br />1. Resolved. <br />IA. Please address the issues in the June 4, 2010 letter from Ms. Turner. <br />Rule 2.03.6 - Right of Entry and Operation Information <br />2. The PR-06 application requests that the Permit Area for the NH 2 Mine be increased by 3.88 <br />acres and requests an increase to the Disturbed Area of 2.4 acres. Numerous revised maps were <br />submitted with the application, illustrating the proposed permit boundary and disturbed area. <br />However, the accompanying legal description, found in Attachment 2.03.8-1, has not been <br />updated. A revised Attachment 2.03.8-1 has been provided, and we have the following <br />comments. <br />a. In the first line of the second paragraph on page 3, the Range for Section 1 is given as R 15 <br />W. The correct location is R 16 W. Please correct the Range for Section 1 of the permit. <br />b. The final area for the NH2 mine (p. 5) is given as "36043409.31" square feet. Please <br />eliminate the "09.31"; portion of this number (it implies a level of accuracy that is not <br />warranted) and insert commas, as follows: "approximately 36,043,400 square feet". <br />c. Page 6 of Attachment 2.03.8-1 describes the boundary of the NH1 mine. The first sentence <br />of the second paragraph contains incorrect Section, Township and Range information, and <br />should read as follows: "...within Section 25, T 47 N, R 16 W..." Please revise the text as <br />noted. <br />Rule 2.04.3 General Requirements: Site Description and Land Use Information <br />3. Resolved. <br />3A. The Pre-Mine Land Use Photo Maps 2.04.3-2 and 2.04.3-3 are listed in the List of Maps, but <br />were not updated and included in the package of revised materials. Please provide the updated <br />photo maps.
