In order to
save some time on my part I will not restate your items but rather answer the concern.
6.4.3 EXHIBIT C- PRE-MINING & MINING MAPS OF THE AFFECTED LANDS
1.) Both maps have been signed. JOE GAGLIANO has signed both maps.
2.) The fence is on the State Highway 160 R.O.W. , which is not closer than 200 feet
to the permit boundary at any point along the south side of the pit.
6.4.4 EXHIBIT D- MINING PLAN
1.) The applicant will agree with the Division of Reclamation, Mining and Safety and
accept that the possible maximum area of disturbance at any one time could be
31.38 acres. Given the three phases range in size from 28.58 acres to 31.38 acres.
Therefore, the applicant commits to a maximum bounding of 31.38 acres when
the Division of Reclamation, Mining and Safety calculates the finical warranty.
2.) The applicant anticipates that no overburden will be stockpiled. The site has little
to no overburden therefore the pit will be stripped to a depth adequate to salvage
ample material to replace the top surface in order to establish a good root zone for
the vegetation that will be seeded this will provide soil that can be called growth
medium.
