Cattany <br />Division Director <br />Natural Resource Trustee <br />Henry Barbe of Mountain Coal Company (MCC) notified me by phone on July 31, 2008 that a <br />MCC self-audit discovered they had mis-reported certain parameter concentrations on their <br />Discharge Monitoring Reports (DMRs) during the period 2nd Quarter 2004 through 1St Quarter <br />2008. The self-audit also discovered deficiencies in filing Materials Containment Plans and <br />Stormwater Management Plans during portions of that time period. MCC filed amended DMRs <br />and the required Materials Containment Plans and Stormwater Management Plans. The <br />amended DMRs indicated the previous mis-reporting failed to recognize exceedances. The <br />exceedances and reporting deficiencies are described in a letter to Kelly Morgan of Colorado <br />Water Quality Control Division (CWQCD) dated July 28, 2008 (DRMS received a copy on July <br />30, 2008). <br />I noted in a letter to Henry Barbe on September 22, 2008 that DRMS was deferring further <br />review of the subject DMRs until CWQCD completes its review. CWQCD has recently <br />completed its review as described in Compliance Order on Consent IC-091201-1 ("COC"). I <br />have conducted a preliminary review of the COC and the subject DMRs and find that the COC <br />adequately addressed all items for the above-referenced time period that are within DRMS's <br />purview relating to Mountain Coal Company's National Pollutant Discharge Elimination System <br />exceedances, DMR reporting deficiencies, and deficiencies in Materials Containment Plans and <br />Stormwater Management Plans; therefore, DRMS review of the above-referenced DMRs and <br />related reports is complete. This finding that DRMS review is complete is preliminary and is <br />subject to change if additional information becomes available. <br />cc: Daniel I.
