CI586 007
I.a-U3
Kaldenbach, Tom
From: Kaldenbach, Tom
Sent: Thursday, February 18, 2010 9:59 AM
To: Hernandez, Daniel
Subject: West Elk Mine (C-1980-007), MR-363
Dan,
David Berry called me this morning and said Kathy Welt had described to him the work proposed in MR-363. David said
he was okay with the work being submitted as an MR as long the beams were installed in a manner that did not
jeapordize the structural integrity of the LRP. I have verified that the MR-363 submittal meets compliance with Rule
4.10. The proposed work requires no additional reclamation bond because the beams will be left in place after mining
ceases. Marcia Talvitie explained in her email to me on 2/17/10 her understanding that neither the size of the plant nor
the magnitude of the loading transferred to the LRP have been altered; therefore, the geotechnical analysis will not
change from what has been previously approved . Based on my review of Rule 4.10 and Marcia's email, I propose that
MR-363 be approved.
Tom Kaldenbach
Environmental Protection Specialist
Colorado Division of Reclamation, Mining and Safety
1313 Sherman St., Room 215
Denver, CO 80203
(303) 866-3567, ext. 8128
