<br />IN THE MATTER OF THE <br />APPLICATION FOR WATER <br />RIGHTS OF: <br />Bill Van Valkenburg <br />12353 State Hwy 14 <br />Walden, CO 80480 <br />SUMMARY OF CONSULTATION <br />The Division Engineer and the Water Referee for the Water Division have consulted conceming the <br />application on file herein. The Division Engineer's continents and recommendations to the Referee <br />are as follows. % , <br />Applicant seeks anew absolute-surface water right -for Spring No. 1 for 5-gall6ns per minute 0011c ts) <br />for livestock use. There is no opposition filed in this case. <br />A field inspection by this office on October 11, 2002 found that the spring is in the NW/4 NE14 of <br />Section 23, Township 6 North, Range 78 West of the 6'" P.M., at a point approximately 1162 feet from <br />the north section line and 2006 feet from the east section line. Flow from the spring surfaces naturally <br />and is collected in a small pond formed by a low berm. Applicant pipes the water from the small pond <br />to an excavated pond with a maximum surface area of approximately one-quarter of an acne. At the <br />time of the inspection, the larger pond was dry. Livestock have access to both ponds. The spring is <br />tributary to Grizzly Creek of the North Platte River. Grizzly Creek is over appropriated and subject to <br />administration. <br />I recommend the Court grant a new absolute surface water right for Spring No. 1 in the amount of <br />0.011 c is for livestock watering. The date of appropriation should be January 1, 2002.
