III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Rob Zuber and Dan Hernandez of the Colorado Division of <br /> Reclamation, Mining and Safety(Division). The mine is a reclaimed surface mine east of Walden, <br /> Colorado with a reclaimed loadout just south of the town of Walden. The weather was generally warm <br /> and clear. No snow covered the mine, Loadout, or access roads. The ground was dry. <br /> Signs and Markers: Permit boundary markers are needed at the following locations at the Loadout: at <br /> the gate, along the east side of the permit boundary, and along the west side of the permit boundary <br /> parallel to the railroad tracks. <br /> Roads: All roads were in good shape with minimal ruts. They were dry at the time of the inspection. <br /> Hvdroloeic Balance: Visual observation of the reference area used in the Sediment Demonstration(see <br /> March 9, 2010 memorandum from MWH) indicated that the values used in the USLE analysis are <br /> appropriate. However, the values used for the reclamation area in the USLE analysis contradict Division <br /> observations: the analysis indicates 0 percent canopy,but the site has a large population of Rubber <br /> Rabbit Brush that is approximately two feet in height. <br /> The loadout pond was full and generally in good shape. The primary spillway pipe needs immediate <br /> cleanout at the downstream end.
