Sorenson <br />Environmental Projection Specialist <br />Division of Reclamation, Mining, & Safety <br />1313 Sherman Street, Rm. 215 <br />Denver, CO 80203 <br />Re: Climax Molybdenum Company, Climax Mine (Permit No. M-1977-493) (CHS #35617) <br />Dear Mr. Sorenson: <br /> <br /> <br />JUN 15 M13 <br />Division of Reclamation, <br />Mining & Safety <br />Thank you for your correspondence dated May 17,2010_ (received by our office on May 19, 2010; additional map <br />received on June 7, 2010) regarding the subject project. <br />A search of the Colorado Cultural Resource Inventory database indicated that several cultural resource inventories <br />have been conducted in the vicinity of the proposed permit area and it appears that there are at least three <br />previously recorded sites located within the proposed areas of new disturbance. Sites 5ST58, 5ST59, and 5ST60 <br />were recorded in 1974 and an official determination of eligibility has not been made for their National Register <br />eligibility. We recommend that the operator avoid these sites or that additional inventory be conducted to <br />determine the effect of the proposed project on these resources. If site avoidance is not possible, we recommend <br />further consultation with our office in order to identify options to avoid, minimize, or mitigate the adverse effect to <br />the sites. Our files contain incomplete information for this area, as most of Colorado has not yet been inventoried <br />for cultural resources. As a result, there is the possibility that as yet unidentified cultural resources exist within the <br />proposed permit area. <br />Since there is Federal agency involvement in this project (portions of the project area are located on land <br />managed by the Arapaho-Roosevelt National Forest), please note that it is the responsibility of the Federal <br />agency to meet the requirements of Section 106 of the National Historic Preservation Act as set forth in 36 CFR <br />800 ("Protection of Historic Properties"). This includes the identification of any historic properties (i.e. cultural <br />resources which are eligible for or are listed in the NRHP) within the area of potential effects and determining <br />whether the undertaking will have an effect upon such properties. The State Historic Preservation Office, <br />Native American tribes, representatives of local governments, and applicants for Federal permits, licenses or <br />other approvaLare entitled, to_eonsultatiye roles in this ,process. <br />Should human remains be discovered during mining activities, the requirements under State law CRS 24-80 part 13 <br />apply and must be followed. <br />Thank you for the opportunity to comment.
